Terms of Service and Privacy



This agreement was written in English (US). To the extent any translated version of this agreement conflicts with the English version, the English version controls. Any infringement of this agreement concerning Disa’s copyright and intellectual property will be subject to the laws of the United States, and foreign laws and international conventions.

Statement of Usage, Responsibilities, and Acceptance


This Statement of Usage and Responsibilities ("Statement," "Terms," or "SRR") derives from the Terms of Service and Privacy, which governs our relationship and agreement between Disa (“We”,“Us”, “Our”, “the developers”, the “co-founders”, the “copyright”, “© Disa Technologies, Inc. 2017”, the “Disa Messenger”, the “software”, the “application”, the “subscription provider”, the “framework”, the “app”, the “site”, the “website”, the “design” or the Disa “servers”), the Disa software, including Disa Messenger (collectively, including all content provided by Disa through Disa Messenger, the Disa website, the "Disa Plugins", or the "Official Plugins"), and you the subscribing user (“you”, “You”, “your”, “use”, “used”, “subscribed”, “subscriber”, or the “licensed user”), a user of the Disa software and website, and others who interact with Disa. By using or accessing Disa, you agree and accept to this Statement and understand that Disa may make changes to this Agreement. You agree and accept that you understand that with these changes DISA MAY REPLACE, UPDATE, OR CHANGE THESE TERMS OF SERVICE (“TOS”) AND PRIVACY FROM TIME TO TIME and recommends that YOU REVIEW THE TOS ON A REGULAR BASIS. You understand, agree, and accept that your CONTINUED USE OF THE SERVICE AFTER THE TOS AND PRIVACY HAS CHANGED CONSTITUTES YOUR ACCEPTANCE OF THE TOS AS REVISED. If you choose NOT to agree, with any of these terms now or in future updates of the TOS and Privacy, you must decline the TOS and Privacy may NOT use DISA OR ITS TECHNOLOGY AND WEBSITE CONTENT AND WE RESERVE THE RIGHT TO CANCEL YOUR SUBSCRIPTION SERVICE. You may review the TOS and Privacy at this web address www.disa.im/tosandprivacy.html, or access it from within the application (in the app settings you will always be able to see it in the “information” tab).


Intellectual Property Rights

1 .The design of the Disa Software along with Disa’s created text, scripts, graphics, interactive features and the like, current or future implementation of a unified status updater, and location based information obtainable through user location sharing, except Profile Status Submissions themselves, and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to Disa subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. Disa software and technology is provided to you AS IS for your information and personal use only. Disa reserves all rights not expressly granted in and to the software, technology, and subscription provisions. You agree to NOT engage in the use, copying, reverse engineering, or distribution of any of the software and technology under any circumstance other than expressly permitted herein, including any use, copying, or distribution of Status Submissions of third parties obtained through the Service for any commercial purposes.


Disa Usage

1. Subject to your compliance with these Terms of Service, Disa grants you permission to use the framework, provided that: (i) your use of the Service as permitted is solely for your personal use, and you are not permitted to resell or charge others for use of or access to the framework, or in any other manner inconsistent with these Terms of Service; (ii) you will not duplicate, transfer, give access to, copy or distribute any part of Disa software in any medium without Disa’s prior written authorization; (iii) you will not attempt to reverse engineer, alter, add to, or modify any part of Disa; (iv) you will not use Disa for any form of spamming, phishing, or commercial advertisement without the written consent from Disa’s head of marketing or head of development; (v) you will not use Disa for or during any illegal “transactions” or “activity” in the jurisdiction you are using Disa in as identified by the law of the presiding land; (vi) Disa grants Users the non-transferable, non-re-licensable, non-exclusive license to use the Contents provided by Disa, only for the purpose of using the framework; (vii) Users shall abide by the appropriate conditions when using Contents which are subject to additional fees and periods of use. Notwithstanding situations where phrases such as "Purchase", "Sales", “Subscription”, and the like appear in the app market, the application itself, and the website. Disa shall remain the holder of all intellectual property rights as well as all other rights in the Contents offered to Users by the Company, and such rights shall not be transferred to Users; and (viii) you will otherwise comply with the terms and conditions of these Terms of Service and Privacy Policy.

2. You affirm that: (i) you understand that you are also subject to the terms of service of the third party services that you use with Disa; (ii) Disa recommends that you review those terms of services associated to every third party service you are using via a plugin, a network connection, or network provider; (iii) You use third party services, third party plugins, and third party software at your own risk.

3. You affirm that you understand that it is your responsibility to research, and inform yourself on third party plugin developers, the third party plugins “behavior”, “usages”, “abilities” and network “usages”, and third party services. Disa cannot promise the behavior or “trustworthiness” of third party plugins, services, and network providers. Disa is not a messaging service. Disa is a messaging “hub”, “message and media organizer”, “message unifier”, “unification subscription provider”, and therefore does not promise the “trustworthiness” or the domestic and international legal behavior of third party services it develops or can work in conjunction with plugins for. This applies to plugins that were both developed by Disa or third party developers.

4. You affirm that you understand Disa is not a messaging “service”. Delivery of data or network messages is the responsibility of the third party “service”. Disa is a messaging, media, file, location, and data user interface intermediate, which will organize your services sent/received/retrieved information, and will send your information (messages, media, files, location, data, and information as described in the Privacy Policy), to the third party “service” you have installed.

5. You affirm that you understand Disa reserves the implicit right to cancel your usage of any Disa developed software at any time for any reason of its choosing regardless of your payment for “subscription”, “upgrades”, or special versions such as but not limited to “pro features”, “extended features”, “pro key”, “pro upgrade”, “Disa pro”, “personal key”, “© Disa Dashboard 2017” and “pro version”.

6. You affirm that you understand: (i) Disa reserves the implicit right to limit, upgrade, add, or remove the ability of using plugins with the framework; (ii) Disa reserves the implicit right at any point in time of Disa’s choosing to lock, add to, or remove from, the amount of plugins allowed to be used simultaneously with any current or future updated version of Disa’s software.

7. You understand and accept that we may be changing parts of, if not all of, this terms of service in the future, and by accepting this you the user are accepting that the further use of any version of Disa website, application, or software will be in respect to the new (“newest”, “most recent”, “current”, “amended”, “updated”, “revised”, “changed”, or “officially altered”) version of Disa’s Terms Of Service. If you choose to decline any updated version of the Terms of Service then you by default decline this current version of the Terms of Service and must cease the use of any Disa website, application, or software.

8. You accept and understand that a decline of any version of a Disa Terms of Service forfeits any previously accepted Terms of Service. You accept and understand that a declined Terms of Service will result in a revocation of any permission by Disa to use any Disa application, software, or website. You understand that the aforementioned statement applies to both currently used and previously used Disa applications, software, or websites regardless if the outdated Terms Of Service was originally accepted from a previous download, update, or published Terms of Service at this web address www.disa.im/tosandprivacy.html.

9. You accept and understand that upon acceptance of this agreement you become a subscribing user (a “subscriber”, “subscription”, or a “licensed user”) of Disa. Regardless of how you have become a user whether by: (I) free subscription [free install or log in]; (ii) paid subscription [paid version for extended software privileges, extended install limitations, or extended website access]; (iii) or via any other subscribing installation of Disa

10. Disa retains the implicit right to restrict, downgrade, revoke, and/or unsubscribe your user license of Disa for any reason Disa decides without restriction of time, location, or residing local law that would otherwise allow you the continued use of Disa after Disa’s revocation of your user subscription license.

11. If Disa ever uses its right to restrict, downgrade, revoke, and/or unsubscribe your user license Disa will not be required for any reason to refund or compensate for any payment. Should Disa ever decide to refund a user or former subscriber any payment you may not expect to receive more than between one month to one years’ worth of a refund, or otherwise decided by Disa. The final decision of the amount of a refund if awarded a refund at all by Disa is solely up to Disa and no other party. No local law outside of the restrictions of a court in the United States Of America (as described in the “Disputes” section of the TOS) may have jurisdiction over a refund dispute with Disa (as described in the “Third Party Plugins, Third Party Services, and Disa’s Exemptions of Liability” section of the TOS).

12. You agree to allow Disa to periodically and automatically collect analytics in respect to the usage of Disa software, your device build information, your system build information, and device location via a data connection in respect to the limitations of the privacy statement, and also for the purpose of but not limited to: (i) commercial sale of said collected analytics, data, and information; (ii) self-diagnostics; (iii) bug reporting, where upon the users selection of the Disa software “bug reporting” feature the software will automatically collect and compile device information into a readable format for the user to send a bug report to Disa’s servers for review and storage. Every user can review the exact readable format and information we see before sending the report. [We do not want or need any personal information that is linked to a user’s name. We take your privacy very seriously and will not collect or store information based on your name unless agreed upon with you to do so in the case of a “pro” feature or upgraded subscription in which we deem it necessary. The Google Play store may allow us to access information as to which Google account holders and Disa users have downloaded Disa software on the Google Play store. Disa does not intend to store this information in its servers. We have no interest in storing your names nor do we have a need to, unless we create a feature that requires us to do so, at which time this TOS will be updated to disclose that. That said, a third party service you may be using or a third party plugin that you may use with Disa could do so. Therefore it is your responsibility to research and understand the behavior or the aforementioned third party services and third party plugins. Please read the privacy agreement to better understand what type of analytics and information Disa may collect].

13. You will not develop, use, or share any software that performs a “phishing” task in or through the use of Disa.

14. You will not develop, use, or share any software that “forks” Disa, or forks third party software through the use of Disa.

15. You will not develop, use, or share any software that is a “worm” in or through the use of Disa.

16. You affirm and understand that Disa beta is a test version meant to have periodic changes to the software, and that Disa recommends you periodically check the Terms Of Service and Privacy Agreement to inform yourself on any changes involving these statements and terms. Disa is not liable (in accordance to the terms in the "Third Party Plugins, Third Party Services, and Disa’s Exemptions of Liability" section).


Third Party Plugins, Third Party Services, and Disa’s Exemptions of Liability

1. In no event shall Disa, its officers, directors, employees, volunteers, moderators, investors, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any: (i) Errors, mistakes, or inaccuracies of content, (ii) Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of Disa, (iii) Any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) Any interruption or cessation of transmission to or from our servers, (iv) Any bugs, viruses, trojan horses, worms, malware, or the like, which may be transmitted to or through Disa, or by any third party, (v) Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via Disa’s plugins or third party services, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages, (vi) Disa does not expressly or impliedly guarantee that the Service (including the Contents) are free from de facto or legal flaws (including but not limited to stability, reliability, accuracy, integrity, effectiveness, fitness for certain purposes, security-related faults, bugs, or infringements of rights). The Company shall not be responsible for providing the Service without such defects; and/or (vii) The disclosure of information pursuant to these terms of service or privacy policy. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

2. You specifically acknowledge that Disa shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party, third party service, or third party developed software, and that the risk of harm or damage from the foregoing rests entirely with you.

3. Anyone that accesses or uses anything developed by Disa does so at their own volition and is responsible for compliance with local law when doing so. You are responsible for all compliance with local law when using Disa and any third party service(s) that can be used with it. You retain all liability in respect to the law or any punitive punishment and “revoke” or “waive” your right to transfer liability to Disa in any way if local law permits.

4. Any infringement in the use of a third party service (any service that “transfers”, “receives”, “sends”, controls “communication transactions” on servers or networks both data and sms other than Disa’s servers), or provided by Disa as an official plugin (plugin developed by Disa and labeled as official within the app plugin manager, and/or website that allows for the connection to a third party service as described above), or provided by a third party developer (a plugin developed for a service by a third party developer which is not labeled as an official plugin in Disa’s app, or on Disa’s website), is subject to the terms of service (“terms of use”), of the third party service(s) in question.

5. You will not hold Disa liable for any negligence on your part.

6. You the user will not hold Disa liable for any claim of not knowing what third party services you are using though a third party developers plugin. By accepting this agreement you accept all liability for; (i) Not researching or accurately informing yourself on the third party plugin(s) you are using; (ii) Not researching or accurately informing yourself on the third party service’s terms of service of which you are held accountable to through the use of the third party plugin as previously stated in the “Disa Usage” terms of this TOS.

7. Disa is not liable for the “information”, “data”, “media”, and all content you transfer through the use of Disa or third party plugins and third party services. By accepting this agreement you agree to exempt, and relinquish any and all liability for your actions whether illegal, damaging, or fatal through the use of Disa in any prosecution involving the law you are under the jurisdiction of in a legal matter.

8. If at all in your legal power you will exempt, forfeit, or relinquish Disa of all disputes, judgments, or decisions for any sort of penalty, compensation, or refund if a dispute has been brought forward by you, or by another party for you with or without your knowledge: (i) in a court outside of the restrictions and limitations described in the “Disputes” section of the TOS; (ii) in court within the restrictions and limitations described in the “Disputes” section of the TOS.


Warranty Disclaimer

YOU AGREE THAT YOUR USE OF DISA SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, DISA, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, MODERATORS, INVESTORS, OR AGENTS, DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH DISA AND YOUR USE THEREOF. DISA MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF DISA'S CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SOFTWARE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICE, (IV) ANY BUGS, WORMS, MALAWARE, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE OR SOFTWARE THROUGH THE ACTIONS OF ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA DISA. DISA DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH DISA SOFTWARE, WEBSITE, FRAMEWORK, OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY USER STATUS SUBMISSION OR OTHER ADVERTISING, AND DISA WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.


Indemnity

You agree to defend, indemnify and hold harmless Disa, its officers, directors, employees, volunteers, moderators, investors, or agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Disa website, software, and framework; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your Status Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of Disa.


Disputes

1. Disa does not have a headquarters and is developed in various locations where development of Disa and its contents are legal in the jurisdiction where developers travel both domestically and internationally. Disa’s copyright was first created in the United States of America; as such, you hereby agree you will resolve any claim, cause of action or dispute (claim) you have with Disa, its officers, directors, employees, volunteers, moderators, investors, or agents; (i) arising out of or relating to this Statement exclusively in a court in the United States of America that does not absolve you, allow you to transfer, relinquish, omit, or forfeit any claim in this agreement; (ii) exclusively in a court in the United States of America that recognizes your acceptance of this agreement as a legally binding Terms of Service and Privacy relationship agreement regardless if you accepted this agreement through Disa software, or the website where an acceptance was or is possible; (iii) without regard to conflict of law provisions.

2. If anyone brings a claim against us related to your actions, content or information through the use of Disa, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. We do not control or direct users' actions with Disa, third party services, or third party developers, and are not responsible for the content or information users transmit or share using Disa. We are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information you may encounter through the use of Disa. We are not responsible for the conduct, whether online or offline, or any user of Disa.


Advertisements

1. Disa reserves the right to provide Users with advertisements for Disa or a third party, through the Service. These advertisements may include but are not limited to location based advertising that can be collected via Disa’s servers as stated in the privacy section. The collected location information will not be collected or stored in relation to any personal name unless agreed upon with the user. Disa intends to only collect and store information, or data that will be related to a uniquely generated individual device specific code or phone number. The purpose of this code will be to link the collected location data to a specific device for the purpose of advertising without a user specific legal unless otherwise stated in this agreement or agreed upon with the user for another purpose.

2. You accept and understand that advertising contents offered by other business partners cooperating with Disa may be included within Disa. The business partners bear all responsibility regarding such contents and/or services offered. Furthermore, such contents and services may be governed by the explicit terms and conditions etc., which are set accordingly by the business partners.


Ability to Accept Terms of Service

You affirm that you are either more than 16 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service and Privacy, and to abide by and comply with these Terms of Service. In any case, you affirm that you are at least 16 years old as Disa is not intended for children under 16. If you are under 16 years of age, you are not permitted to use the Disa without parental or guardian consent. You further represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a” terrorist-supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Disa is the developer of the software, with an international copyright first created in the United States of America and currently holding an address at http://www.disa.im reachable through info at disa.im (info@disa.im).


Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Disa without restriction.


Subscription / Subscribers / User

What is a User in relation to being a Subscriber of Disa?

As a “user” you are a “subscriber”. As a subscriber you are not an owner of Disa, its software, website, official plugins, third party services, third party plugins, or license. You understand and accept that you are limited to a license that is owned by Disa and its copyright. The license can be revoked as mentioned previously in this agreement at any time, location, and under any local law exempting you of needing a license to use Disa. We must accept this so that we have the implicit right to revoke subscription and user license to known terrorists should we decide to do so because we do not condone terrorism in this world, and for any other reason we haven’t stated or can think of at the moment but may need the ability to do so in the future.


What is the difference of a free subscriber and a paid subscriber?

Anyone who accepts this Terms of Service and Privacy agreement automatically becomes a free subscriber while using Disa and is subject to licensing restrictions as previously stated in this TOS. Paid subscribers are still “subscribers” and subject to the licensing restrictions as previously stated in this TOS. The only difference is that a paid subscriber may have less restricted access to a higher subscription level that allows access to more features and less limited use of Disa’s software or website. This paid subscription status may be more commonly known as a “pro level”, or “upgraded subscription”. It is important to know that by accepting this agreement you are accepting that regardless of payment to Disa for a paid subscriber access you are still under a “subscriber” license which we hold the implicit right to revoke, limit, or downgrade at any time.


Privacy Policy

We, Disa (“we,” “us,”, “our”, the “Disa servers”, the “website”, the “site”, the “framework”, or the “software”), believe your privacy is very important.

Disa recognizes that its visitors and users want to be informed and have a good idea about how their privacy is being handled by us, and what is our policy for the current use of the Disa software with respect to your privacy. Disa provides this Privacy Policy to help you make an informed decision about whether to use or continue using the Disa software, and the Disa website. We are disclosing to you the user that this Privacy Policy is intended only for what Disa knowingly and purposely will do, however we want you to be informed and to understand that because of the nature of the developed product being a framework that integrates third party developed software, services, and communication technologies, we cannot be responsible for how they interact with the framework and their behavior as third party development may be open sourced once the Disa “plugin framework” is open sourced. Disa strongly recommends as stated in the Terms of Service that you periodically do your research to inform yourself on the nature and behavior of third party services, third party developed plugins, and their updates by reviewing their “terms of service” and by other means of research as you see fit. If you do not agree to our practices, or those of third party services, or third party developed plugins, please DO NOT use Disa software, the Disa website, third party services, and third party plugins.

Please note that any Status Submissions or other content posted at the direction or discretion of users of Disa, and the third party services you may use becomes published content and is not considered personally identifiable information subject to this Privacy Policy. The aforementioned statement is important for you to understand because this is software that unifies multiple services of which your status messages may be posted by you, and we cannot control the publishing of that material as well as the messages you send. Those privacy settings are set by the third party service managing the transactions of your messages. Disa only organizes them neatly for you and makes it easier for you to access certain third party features. Again, please review the terms of service for all third party services and third party developed plugins you are using to understand their privacy policies, their behavior, and legality.

This Privacy Policy is incorporated into and is subject to the Disa Terms of Service. Your use of the Disa website, the software, and any personal information you provide therein; or is collected by the Disa site or Disa software, remains subject to the terms of this Privacy Policy and our Terms of Service. The contents of the Privacy Policy may change from time to time as we update the framework and develop new ideas or incorporate new features. You must review the Privacy Policy as the Terms of Service is updated as it is subject to and incorporated within the Terms of Service. Updates can be reviewed at this web address www.disa.im/tosandprivacy.html.

What Does This Privacy Policy Cover?

This Privacy Policy is part of Disa’s Terms of Service and covers the treatment of user information, user location information, device information, and personally identifying information, obtained by Disa, including information obtained when you access the Disa Site, or any other software provided by Disa. Again, please understand that Disa is not responsible for how both your personal and non-personal information “interacts”, is “used”, or is “stored” by third party services. Again, we recommend that you please be informed on the choices of services you use by reviewing their terms of service and researching their behavior. Again, we recommend that when you are in doubt of a service and its behavior please uninstall that plugin service, or stop using Disa.

This Privacy Policy does not apply to the practices of companies, third party plugins, or services that Disa does not own or control, or to individuals whom Disa does not employ or manage, including any of the third parties to which Disa may disclose user information as set forth in this Privacy Policy.


What information does Disa collect and is it stored by Disa?

The information Disa collects is different from what Disa can access, so please review the section about what Disa software accesses to understand the difference. With your use of Disa we will collect information periodically via server fetching through your data connection, (as many commonly used application services using servers do), for various reasons such as: (i) self-diagnostics; (ii) development purposes; (iii) keep a count of the amount of users using the Disa; (iv) statistical calculations for data selling; (v) compatibility checks; (vi) and for third party advertising. Below we will cover what information is collected and what is stored. What information does Disa access from your third party services?

Disa’s software is capable of accessing information based off the limits of the third party service. Each third party service has different limits as to what information that can be accessed so we recommend that you review their privacy policies. A plugin can only request to access information through Disa’s framework based on the software’s intended purposes. The following list is a disclosure of Disa’s intended purposes for accessing information from a third party service:

(i) Messages

a. Receiving/sending messages in real time from the plugin/service. Messages can be text, media (images, video, and audio), stickers, emoji’s, or files.
b. Message sync: Ensuring that the local copy in Disa’s database is the same as what’s interfaced by the plugin (the plugin may interface via an online database, or another database that sits on the device (such as the Android SMS-MMS database).
c. Message pulling: Loading additional messages in from a services database (this includes SMS-MMS databases on the device), as they are requested by the user.
d. Fetching information shared between all messages: timestamp, participant address, message sender vs receiver direction, message type (group/party message, or solo message), status (sent, delivered, waiting, failed).

(ii) Fetching/sending data on whether a user or conversation participant is typing or not;

(iii) fetching/sending data when a user or conversation participant has read a particular conversation;

(iv) fetching/sending data when a user or a third party service member’s presence has changed (active/online, offline);

(v) fetching when a user or party participant has received a message (delivered status);

(vi) fetching a user’s last seen time if their presence is offline;

(vii) fetching a conversations title;

(viii) fetching a conversations assigned photo, (for a thumbnail, or contact card);

(ix) fetching a conversation’s participants;

(x) fetching a participant’s/contact’s assigned photo, (for a thumbnail, or contact card);

(xi) “user interface controls”: Initiated by the user to fetch more information regarding all purposes stated in this section);

(xii) creating a message/group message with a contact(s) or third party service member(s) and fetching their information;

(xiii) loading a list of members from a third party service, or a contact list from a device’s internally stored database;

(xiv) fetching of a particular contact’s information;

(xv) fetching, adding, removing, or promoting participants of a conversation;

(xvi) fetching and changing of a conversation’s title & thumbnail;

(xvii) “privacy”: Fetching, adding and removing contacts on a ban list;

(xviii) “user profile”: Updating, fetching, and setting status of your user account for a third party service;

(xix) Fetching “plugin settings”: These settings are implemented by the plugin developer to instruct the framework (Disa recommends you review: (i) the “What information does Disa allow third party services to access?”; (ii) the “What information does Disa allow third party plugin developers to access?”; and (iii) the “Third Party Plugins, Third Party Services, and Disa’s Exemptions of Liability” sections). Disa’s framework will launch the settings and perform its instructions within the limitations of the framework with respect to every purpose mentioned in this section;

(xx) server syncing your Disa with the services to keep incoming and outgoing messages up to date. This includes syncing timestamps along with the message and the sender or receivers server identification;

(xxi) fetching location at user request for the purpose of the location sharing features for “mapping” or “pin point”.

What information does Disa access on your mobile device?

Disa’s device access permission details are always available at the applications install window before you accept the installation on Android devices. This is a handy and very effective listing tool of the Android system that helps to safeguard you by giving you the software’s operating system access permission information. You can also access this permission list from the installed app list in your Android device. For the most up to date permissions we recommend that you visit that list periodically after every update. The permissions will never change during the period between updates.

That list, although accurate to the category of permissions Disa needs to access to perform its software’s tasks, can be misleading to those who do not understand what the permissions are used for due to the vagueness of the categories. We hope the following list of purposes for device access permissions will help you to understand what Disa uses them for:

(i) All the purposes listed in the “What information does Disa access from your third party services?” section, to perform those tasks;

(ii) All the purposes listed in the “What information does Disa collect and is it stored by Disa?” section, to perform those tasks;

(iii) Open default web browser to open/load links and forms;

(iv) Pull contact information for Disa’s user interface, thumbnail and profile picture generation, storing a new phone number to the “phonebook”, “contact list”, creating a new message for the requested service that may require the contact to already be in your phonebook rather than on their servers, creating a new group chat (“party”), populate the conversation list with the associated contacts that messages are being sent, received, or associated with;

(v) Setting your default device settings in Disa;

(vi) Setting your default system operating system in Disa;

(vii) Controlling Disa’s “settings” that interact with the operating system functions;

(viii) Controlling Disa’s “settings” that interact with the device hardware functions;

(ix) Modifying what is stored by Disa on your devices storage locations;

(x) Verify your devices default account access’s for the services that you’re already logged into controlled by your devices operating system software, for contact cards information, and to open applications when associated to a received, or sent file that you want to open;

(xi) Store log files when logging is enabled for the purpose of troubleshooting if the log file needs to be sent to us manually by a user for review;

(xii) Initiate phone calls using a phone number.


What information does Disa allow third party services to access?

Disa allows third party services to access anything Disa can access within the limitation of our Terms of Service and Privacy agreement with you the user. Keeping that in mind we recommend strongly that you review the Terms of Service and Privacy Policies of the third party services you are using with Disa via plugins or Network Provider services. It is not our responsibility to inform you of what these services are capable of or their behavior when accessing information through Disa within the limitations of Disa’s software. Disa DOES NOT allow for services to poll, pull, or collect information from the software that is outside the scope of their messaging tasks. Disa’s intent is to only allow third party services to access information Disa sends to them for the purpose of delivering your messages, files, location, media, to maintain the connection requirements of their servers to remain logged in, to call for user interface control information, or to give an advertising partner non-personal identifying information within the limits of Disa’s Privacy Policy. Disa DOES NOT allow for services to interact with one another for the purpose of sharing information. Disa intends to be the sole connection between any services you are using with Disa. After all, one of Disa’s main purposes is to handle the organization and interaction between merging and unifying messages for you. Third party services have no ability to manipulate or cause any interaction with another third part service in Disa’s software.

What information does Disa allow third party plugin developers to access?

A “plugin” is just a form of technology used to connect software to a framework. In accordance with the TOS, Disa DOES NOT give permission for plugin developers to poll, pull, or collect information through the use of Disa’s framework for their own personal use. Disa intends to protect you within the reasonable expectation of a “multi service framework” to NOT ALLOW plugin developers to interact with other services and share or collect information for their personal use. Your privacy safety is important to us and that is why Disa acts as the intermediate software to do the user interface interactions and manipulations for you.

Our Intent and Statement on Data Security

Disa uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to Disa and you do so at your own risk. Using unsecured Wi-Fi or other unprotected networks to submit messages through Disa to your connected services is never recommended. Once we receive your transmission of information, Disa makes commercially reasonable efforts to ensure the security of our systems and software data security. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If Disa learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. Disa may post a notice on the Disa website or through the Disa mobile application via an update if a security breach occurs.


By accepting this Terms of Service and Privacy Policy agreement you are accepting all of the above statements without prejudice or neglect and agree that everything stated is perfectly fine and acceptable for you as the usage responsibilities and relationship with us, Disa.
